PD in Canada as a pre-1949 photo. Very likely to be in the public domain in the U.S., too, due to its age (if published, likely to have happened pre-1923; if unpublished, photographer very likely to have died before 1935, and the photograph was certainly created more than 125 years ago). Note that Hammond lived 1876 – 1934 and cannot have been the photographer.
